AND THEN ADVERTISING!


Some national publications located in Tashkent, refuse to accept announcements and advertising from private individuals if those are not citizens of Uzbekistan or have no a registration in capital.


For example, an employee of the newspaper "Private sector" - appendices to a weekly journal "PressTIJ" - accepting announcements, referred to the Regulations about placing of advertising which is authorized by the decision of the State Committee on De-Monopolization and Development of Competition under #4 from March 26, 2001. In clause 13 of the given document it is written: "At the publication of private announcements of physical persons allowed the conclusion of agreements with advertizers in various forms (blank-orders, applications etc.) with the obligatory indication of the necessary information on the advertizer (passport data)".


For the remark, that in this position it is not specified, that is forbidden to accept advertising from citizens of Kazakhstan, Kyrgyzstan or other states and in general there is no any mention of a registration, an employee has persistently answered, that clause 13 means all the same. And consequently she refuses anyone if, certainly, he(she) does not have temporary or permanent registration. That, this is an infringement of clause 23 of the national Constitution, in which it is written: "To foreign citizens and persons without the citizenship, being in territory of Republic of Uzbekistan, rights and freedoms are provided in conformity with norms of international law", the employee of "Private sector", probably, did not know. However, that didn't excite her.


"And if advertising is brought by the citizen of Uzbekistan constantly living, for example, in Russia or Germany, or France?" I have taken an interest. "Well, he has Uzbek registration", the woman has uncertainly answered. Having learned, that such mark in the Uzbek passport of the citizens living outside of Uzbekistan, does not exist, she has declared: "Then we may not publish the announcement."


She has confirmed with this, that the publication breaks one more clause of the Constitution (18) in which it is written: "All citizens of the Republic of Uzbekistan have equal rights and freedoms. They are equal before the law without distinction of a sex, race, nationality, language, religion, social origin, belief, personal and social situation". Where to watch to "peace officers", however they are engaged, far from protection of rights of citizens. You see, you will not make an "income" on the Constitution, and on infringements of nonexistent documents it is possible to acquire a profit.


After conversation in "Private sector" I have made voyage on floors of a publishing complex "Sharq" with the purpose to define how is put the issue in other places. In a department of reception of advertising of the following newspaper have been added, that the city registration is required, differently they will not take the announcement. Same have been confirmed in a cabinet on which door it was written: "Arguments and the Facts": it is impossible to accept announcements of job seekers form the person not having a capital registration or being the citizen of other country as it contradicts the law on advertising. However, no any clause was revealed by me in the given law devoted to an interdiction of reception of announcements because of a registration. "And if I am going to buy a parrot?" I have asked. Having frowned from reflection, an employee in a result has told, that it still is possible for publishing.


It is necessary to recognize, that this is not a "sin" of all editions. The interrogations which have been carried out in weekly journals "Tasvir", "ECO", "Business Bulletin of the East", have shown, that the main thing is the passport from which the data are taken, however presence of a city registration is not significant. Some journalists have told, that advertisements are read by repressive structures, and if the advertizer is not the inhabitant of Tashkent and even Uzbekistan, so they strictly punish editions for absence of the control. However, any documents regulating punishment for similar activity, was not revealed in the laws in force, open official documents, as well as attempts to find clause in Criminal and other codes of republic. Only it is not clear, why to give to mass media the status of controlling body? In what consists the crime if the announcement is given by the foreigner?


So the question remained open: whether it is the own initiative of newspapers or the clumsy help of the state censorship?


By the way, because of absence of a registration in capital already it is a lot of months while repressive bodies torment the journalist Emiliya Li, not allowing her to live and work in Tashkent. There too they refer on anticonstitutional acts and letters of departments.


Note: The registration is the sanction of local authorities to residing of the citizen or the non-resident in the given territory. It was kept in Uzbekistan from Soviet times and is a powerful antistimulator of democratic transformations, discriminates people on a residence, is one of the sources for corruption.
